What is temporary employment?
In recent years, temporary employment has become more and more popular. In times of increasing demands for flexibility, temporary employment is a perfect instrument for modern employment policy.
Temporary employment companies are normal employers just like other companies. The employee normally concludes an unlimited full-time employment contract with the temporary employment company. Nevertheless, the temporary employment company delegates their employees to the companies which require suitable personnel. The period of employment in a company can vary. Normally the following applies: When the employee is more qualified, the employment is longer.
In Germany, temporary employment is comprehensively regulated by law. Temporary employment companies are subject to a general license requirement and regular controls by the regional council of the Federal Employment Office (Bundesagentur für Arbeit). The Act of Temporary Employment (AÜG, Arbeitnehmerüberlassungsgesetz) applies and this very clearly emphasises the protection of the employee. Employees in temporary employment have the same rights and social contributions as other employees.
These are in detail:
- Health, accident, pension, unemployment and nursing care insurance
- Paid holiday
- The general Labour Law
- The whole Industrial Safety Legislation
- The Employment Protection Act
- Continued Payment of Wages and Salaries Act
- The Maternity Protection Act etc.
The topics health care and occupational safety are especially emphasised in temporary employment companies, too.
